Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Colin Gillingham, doing business as TractorBeam ("we," "us," or "our"), governing your access to and use of the TractorBeam service.

By creating an account or using TractorBeam, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our service.

Description of Service

TractorBeam is an AI-powered accountability coaching service that conducts scheduled phone calls to help you build habits and achieve personal goals. Our service includes:

  • Scheduled outbound phone calls from an AI accountability partner
  • Personalized conversations based on your goals and progress
  • Progress tracking and habit formation support
  • Conversation memory for continuity across sessions
  • Optional weekly summary emails

Account Requirements

To use TractorBeam, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction
  • Provide a valid phone number that can receive calls and SMS messages
  • Maintain accurate account information and update it as needed
  • Keep your account secure and notify us of any unauthorized access

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription and Payments

Free Tier

We offer a free tier that includes up to 4 check-in calls per month. Free tier users have access to core features with usage limitations.

Paid Subscriptions

Paid subscription plans provide additional calls and features. Current plans include:

  • Pro ($49/month): Up to 20 check-in calls per month
  • Daily ($79/month): Up to 30 check-in calls per month

Pricing and plan features are subject to change with notice.

Billing

Subscriptions are billed monthly in advance through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until then.

Refunds

We do not provide refunds for partial billing periods. If you believe you have been charged in error, please contact us within 30 days of the charge.

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose or in violation of any laws
  • Harass, abuse, or harm our AI systems or other users
  • Attempt to gain unauthorized access to our systems or data
  • Use the service to transmit malware or harmful content
  • Interfere with or disrupt the service or its infrastructure
  • Impersonate any person or entity
  • Use automated systems to access the service without permission
  • Resell or redistribute the service without authorization

Call Recording Consent

By using TractorBeam, you consent to the recording and transcription of all check-in calls. These recordings are used to:

  • Provide personalized coaching based on your conversation history
  • Track your progress toward goals
  • Improve our AI systems and service quality
  • Generate summaries and insights for your benefit

You may request deletion of your call recordings by deleting your account or contacting us.

TractorBeam is not a medical, mental health, or therapeutic service. Our AI accountability partners are not licensed healthcare professionals, therapists, counselors, or medical providers.

The service is intended for general wellness and habit formation purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis or medical emergency, please contact emergency services or a qualified healthcare provider immediately.

We make no guarantees about the outcomes you will achieve. Results depend on your individual effort, circumstances, and commitment.

Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless TractorBeam, its owner, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service or violation of these Terms.

Intellectual Property

The TractorBeam service, including its design, features, content, and technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

You retain ownership of the content you provide (goals, progress updates, etc.), but grant us a license to use this content to provide and improve the service.

Termination

We may suspend or terminate your access to the service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the service immediately ceases.

You may terminate your account at any time by contacting us or using the account deletion feature if available.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved in the courts of California.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the updated Terms.
